My Moves Matter App Privacy Notice

My Moves Matter (“the Company”, “we”, “us”, “our”) takes its responsibilities under applicable data protection law, including the General Data Protection Regulation (“GDPR”) and implementing legislation (“Data Protection Law”) very seriously.  The purpose of this notice is to inform you of the data relating to you that we may collect and use and the uses (including disclosures to third parties) we may make of your data in connection with this App.

 

The Company is the controller in respect of your data and is registered under registration number       725514 and has its registered office at 15 Fortfield Drive Terenure, Dublin  6W, Ireland.

1. About

My Moves Matter mobile App (the “App”) is a self-care companion providing you with the knowledge, insights, support and community to empower you to live the life you want. It has been developed by women with Parkinson’s for women with Parkinson’s. You will learn what works for you and what doesn’t – from the timing of your medication, to the timing of your meals and exercise, be able to access support from experts in Parkinson’s and from your peers who are at the same stage as you and be able to share your learnings and insights with your health care providers.

2. Personal Data that we collect and process

We collect and process personal data relating to you in connection with your use of the App and our relationship with you.  If you use our App in connection with our website www.mymovesmatter.com, the privacy notice https://www.mymovesmatter.com/privacy-policy with website specific details will apply.

In order to use the App, a user account must be created for you. The personal data collected from you in order to create this account may include the following information:

  • Your name, your email address; and your country of residence

  • Payment information if required for certain services

 

Article 9 GDPR prescribes that an individual must explicitly consent to the processing of a set of special categories of personal data which are considered to be “sensitive personal data” and these include health data, which we will obtain through the tracking capabilities of the App.

 

In order to use the tracking capabilities of the App you may also provide us with the following optional information:

  • The details of your symptoms, medication, menstrual cycle, diet, sleep and exercise routine (“Health Data”)

We will also ask for consent to share your data if we believe your data would be useful for a specific research study

 

3. Payment

  • Free and paid versions of the App can be obtained on iOS via Apple App Store and Android via Google  Play Store.

  • Both stores will collect certain amount of personal data to be able to process your payment. For privacy notice please review

5. Purposes of processing and legal bases

We will use personal data relating to you for the purposes of:

  • Facilitating your use of the App in accordance with the Terms and Conditions: https://www.mymovesmatter.com/terms-and-conditions

  • Enabling you to store your Health Data on the App and make it available to others (if you have consented to this)

  • Contacting you from time to time to provide you with:

  • Content relevant to Parkinsons Disease such as blogs, newsletters, e-books, recipes, courses;

  • Progress updates, invitation to presentation of newly available features App;

  • Content helping you to better manage fluctuations in symptoms of Parkinson’s Disease; and

  • Research studies related to Parkinson which might be of interest to you.

  • We will ask you for consent to share your data if we believe your data would be useful for a specific research study

Health data obtained for during the tracking process will be used to:

 

  • Provide you with insights and correlation between your symptoms, medication, menstrual cycle, diet, sleep and exercise routine.

  • Develop mathematical forecasting models to be able to provide suggestions on personalised behavioural adjustment.

  • Provide you with summary pages which you can share with your physician and therapists

 

The legal bases on which we collect and process your personal data in the manner described above are:

 

  • Where any such processing is necessary for the performance of a contract with you (i.e. the Terms and conditions for the use of the App) or for taking steps at your request with a view to entering into a contract with you (e.g. processing your registration details).

  • Where we rely on you having consented to our use of your data (e.g. where we process your Health Data) that you have given your consent to the processing.

 

Where we process sensitive personal data relating to you, we also need an additional legitimising condition to do this. The additional legitimising condition we rely on to collect and process your health data is your explicit consent.  You can withdraw your consent at any time by changing your settings on the App or by emailing us at dataregulation@mymovesmatter.com.  

6. Recipients of Data

We will not disclose your personal data to other organisations other than our service providers or professional advisors who require access to it in order to provide services to us, or where we are obliged to disclose it under applicable law.

If we believe your data would be useful for a specific research study, we will explicitly ask you for your consent before sharing any personal data.

We will not hold your personal data for longer than is necessary. We retain your personal data for as long as we need it for the purposes described in this notice, or to comply with our obligations under applicable law and, if relevant, to deal with any claim or dispute that might arise between you and us.

7. Transfers Abroad

In connection with the above we will not transfer your data outside the European Economic Area and UK.

 

8. Your rights and how to update your information

You have the following rights, in certain circumstances and subject to certain restrictions, in relation to your personal data:

 

  • Right to access the data – You have the right to request a copy of the personal data that we hold about you, together with other information about our processing of that personal data.

 

  • Right to rectification – You have the right to request that any inaccurate data that is held about you is corrected, or if we have incomplete information you may request that we update the information such that it is complete.

 

  • Right to erasure – You have the right to request us to delete personal data that we hold about you. This is sometimes referred to as the right to be forgotten.

 

  • Right to restriction of processing or to object to processing – You have the right to request that we no longer process your personal data for particular purposes, or to object to our processing of your personal data for particular purposes.

 

  • Right to data portability – You have the right to request us to provide you, or a third party, with a copy of your personal data in a structured, commonly used machine readable format.

 

  • Right to withdraw your consent – Where our processing of your personal data is based on you having provided your consent, you have the right to withdraw such consent.

 

Please note that these rights are not absolute, and are subject to certain restrictions and exemptions.  For example, the right to erasure of personal data will not apply where we have a legitimate reason to continue to hold such data.

The Company is required to keep all data accurate and up to date.  To enable us to do this more easily, please ensure that you keep us up to date with any changes to your personal data.  

 

9. Complaints

If you are not happy with the way we have used your information or addressed your rights, you have the right to make a complaint to the Irish Data Protection Commission (https://forms.dataprotection.ie/contact).
